WAIVER RELEASE

Effective Date: January 1, 2026

IMPORTANT NOTICE:

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE SIGNING. THIS IS A LEGALLY BINDING AGREEMENT THAT WAIVES CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. BY SIGNING THIS WAIVER, YOU ARE GIVING UP SUBSTANTIAL LEGAL RIGHTS ON BEHALF OF YOURSELF AND YOUR CHILD.

 

By registering for and participating in Momentum³ programs, the parent or legal guardian (I, the undersigned parent or legal guardian acknowledges, on behalf of myself, my child, and our respective heirs, assigns, and legal representatives, acknowledge and agrees to the following terms on behalf of themselves and the athlete.

 

1. Assumption of RiskAcknowledgment and Description of Risks

I understand and acknowledge that participation in athletic training, physical activity, sports programs, camps, mental performance exercises, and wellness programming involves inherent and significant risks, including. These risks include but are not limited to:

 

  • Physical injuries ranging from minor (sprains, strains, bruises, cuts) to severe (broken bones, concussions, ligament tears)

  • Injuries resulting from contact with other participants, equipment, or playing surfaces

  • Heat-related illnesses including heat exhaustion or heat stroke

  • Allergic reactions or pre-existing medical condition complications

  • Injuries from slips, trips, and falls

  • In rare and extreme circumstances, permanent disability or death

 

I understand that these risks exist even when safety precautions are in place and regardless of the care taken by Momentum³ staff and coaches.

 

2. Voluntary Participation and Assumption of Risk

I knowingly and voluntarily acknowledge that participation is voluntary and, with full knowledge of the risks described above, I hereby expressly and voluntarily assume all risks associated with enrollment and participation in any and all Momentum³ programs and activities. I accept full responsibility for any injury, illness, damage, or loss that the Participant may sustain as a result of participation.

 

3. Release and Waiver of Liability

I release and hold harmless Momentum³, its owners, partners, coaches, staff, volunteers, and affiliated facilities from any and all claims, demands, or causes of action arising from participation in Momentum³ programs, except in cases of gross negligence or willful misconduct as defined by law. In consideration of being permitted to participate in Momentum³ programs, I, for myself and on behalf of the Participant, our heirs, assigns, personal representatives, and next of kin, HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Momentum³, its owners, directors, officers, employees, coaches, volunteers, contractors, agents, affiliates, and facility owners/operators (collectively, the Released Parties) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, illness, or death that may be sustained by the Participant or any property belonging to the Participant, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES, OR OTHERWISE, while participating in Momentum³ programs or activities, or while on the premises where programs are conducted.

 

This release includes, but is not limited to, claims for personal injury, wrongful death, property damage, or any other damages arising from: (a) the Participant’s participation in programs; (b) transportation to or from program locations; (c) the use of facilities or equipment; (d) the actions or omissions of staff, coaches, or other participants; or (e) the condition of facilities or equipment.

 

4. Indemnification

I agree to INDEMNIFY, DEFEND, and HOLD HARMLESS the Released Parties from and against any and all claims, demands, causes of action, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) any injury, illness, death, or property damage sustained by the Participant; (b) the Participant’s violation of these terms; or (c) the Participant’s violation of any rights of another person or entity.

 

5. Medical Fitness and Authorization

I affirm and certify that the Participant is physically and emotionally capable of participating in Momentum³ programs and does not have any medical condition that would prevent safe participation, unless previously disclosed to Momentum³ in writing. Momentum³ does not provide medical care or mental health treatment. I understand that Momentum³ does not provide medical diagnosis, treatment, or mental health therapy.

 

In the event of an emergency, I authorize Momentum³ staff to seek immediate and appropriate medical care, treatment, or transport (including but not limited to calling 911 and arranging ambulance transport) if I cannot be reached immediately. I agree to be responsible for all costs associated with such medical care and transportation.

 

6. MindLAB & Athletic Wellness Club Services Disclaimer and Educational Nature of Programs

I acknowledge that MindLAB and Athletic Wellness Club services, Athletic Wellness Club, and all other Momentum³ programs are educational and performance-support based in nature and do not constitute, replace, or substitute for medical, mental health, or therapeutic care provided by licensed healthcare professionals. I understand that Momentum³ staff are not licensed medical or mental health providers and do not diagnose, treat, or prescribe medication for medical or psychological conditions.

 

7. Code of Conduct and Removal

I understand that Momentum³ maintains behavioral safety standards to ensure a safe, respectful, and productive environment for all participants. Momentum³ has the sole and absolute right to remove the Participant from a program for conduct that compromises safety or program integrity, immediately and without prior notice. If the Participant’s conduct, in Momentum³’s sole judgment: (a) compromises safety; (b) disrupts programming; (c) violates behavioral standards; or (d) is otherwise inappropriate. I acknowledge that no refund will be provided if the Participant is removed for behavioral or conduct violations.

 

8. Photo, Video, and Media Release

I grant Momentum³ and its representatives the irrevocable, perpetual, royalty-free right and permission for Momentum³ to photograph or record my child during programs for promotional or educational use, reproduce, publish, and distribute photographs, video recordings, audio recordings, or other media of the Participant taken during programs for promotional, educational, marketing, advertising, or social media purposes without compensation unless I submit a written opt-out request prior to the program start date to:

programs@momentum-3.com. I understand that opt-out requests must be renewed annually.

 

9. Insurance

I understand and acknowledge that Momentum³ does not provide health, accident, or disability insurance for participants. I represent that the Participant has, or I will obtain, adequate health and accident insurance coverage for the Participant before participation begins. I agree that I am solely responsible for all medical expenses, deductibles, and co-payments incurred as a result of any injury or illness sustained during participation.

 

10. Transportation

I understand that Momentum³ does not provide transportation to or from programs. I am solely responsible for ensuring the Participant arrives at and is picked up from program locations safely and on time. I agree to ensure that the Participant is picked up promptly at the conclusion of each session.

 

11. Severability

I have read and understand this Waiver & Release and agree to its terms on behalf of myself and the Participant. If any provision of this Waiver is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

 

12. Governing Law and Jurisdiction

This Waiver shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles. Any dispute arising from this Waiver shall be subject to the exclusive jurisdiction of the courts located in Northern Virginia.

 

13. Acknowledgment and Voluntary Agreement

I HAVE CAREFULLY READ THIS WAIVER, ASSUMPTION OF RISK, AND RELEASE OF LIABILITY AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND MOMENTUM³. I SIGN IT VOLUNTARILY AND OF MY OWN FREE WILL WITH THE INTENT TO BE LEGALLY BOUND.
