Welcome to the Momentum³ website and services. By accessing or using this website, mobile applications, and registering for Momentum³ programs, you agree to the following Terms & Conditions. If you do not agree to these terms, please do not use our website or services. Please read them carefully.
1. Acceptance of Terms
By accessing or using Momentum³ services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy. If you are registering a minor, you represent that you are the parent or legal guardian and have authority to agree to these terms on their behalf.
2. Use of Website and Services
The Momentum³ website and related services are intended to provide information about our programs, services, and community. You agree to use this website our services for lawful purposes only and in a manner that does not:

3. Program Registration and Participation
Participation in Momentum³ programs, including summer camps, training sessions, MindLAB, and Athletic Wellness Club services, is voluntary and subject to availability and acceptance.
Parents or legal guardians are responsible for:

Ensuring that the athlete is physically and emotionally prepared to participate

Disclosing any medical conditions, allergies, or special needs that may affect participation

Ensuring the athlete follows all program rules and guidelines
Momentum³ programs are designed for athletic development and education and are not a substitute for medical care or mental health care. We reserve the right to deny or revoke participation if we determine, in our sole discretion, that participation would be inappropriate or unsafe.
4. Registration and Payments

Program registration is completed online or through approved Momentum³ registration platforms.

Payment terms, fees, and cancellation policies, and deadlines are clearly communicated during registration and available on our website.

Failure to complete payment All fees must be paid in full by the specified deadline. Non-payment may result in loss of enrollment or participation privileges.

We accept payment via credit card, debit card, and other methods specified during registration. All payments are processed securely through third-party payment processors.
Refund, cancellation, and credit policies are outlined separately and available on our website and incorporated by reference into these terms. Please review them carefully before registering, registration refunds may be limited or unavailable depending on timing and circumstances.
5. Athlete Conduct and Safety
Momentum³ maintains standards of behavior to ensure a safe, respectful, and productive environment for all participants.
All athletes are expected to:

Treat staff, coaches, and fellow participants with respect

Follow all safety guidelines and instructions

Refrain from bullying, harassment, or discriminatory behavior

Use equipment and facilities responsibly
We reserve the right to remove an athlete from a program if behavior/conduct compromises safety, disrupts programming, or violates community standards or our code of conduct. In such cases, refunds are not guaranteed and will be determined at Momentum³’s sole discretion.
6. Assumption of Risk and Waiver of Liability
Participation in athletics involves inherent physical activity risks and related activities involves inherent risks, including but not limited to physical injury, illness, or in extreme cases, death. By enrolling, parents or guardians acknowledge and accept expressly assume these risks on behalf of themselves and the athlete.
Momentum³ is not responsible for injuries or incidents beyond what is reasonably expected in supervised athletic activity, except where required by law. To the fullest extent permitted by law, participants and their parents/guardians agree to release, waive, discharge, and hold harmless Momentum³, its owners, employees, coaches, volunteers, and affiliates from any and all liability, claims, demands, or causes of action arising from participation in programs, except for claims arising from gross negligence or willful misconduct.
7. MindLAB and Athletic Wellness Club Disclaimer
MindLAB and Athletic Wellness Club services focus on mental performance education, recovery practices, and wellness support. These programs are designed to complement, not replace, professional medical or mental health care.
These services:

Do not provide medical diagnosis, or treatment, or prescribe medication

Do not replace licensed medical or mental health professionals

Are intended for educational and performance support purposes only

Should not be relied upon for medical emergencies or crisis situations
Participation is voluntary and based on informed consent. Parents/guardians should consult with appropriate healthcare professionals regarding any medical or mental health concerns.
8. Media ReleasePhoto and Video Consent
Momentum³ may photograph or record activities for promotional or, educational, or social media purposes. By participating, you grant permission Momentum³ a perpetual, royalty-free license for Momentum³ to use images or video, reproduce, distribute, and display photographs, videos, or other media of participants unless a written opt-out request is submitted in advance to: programs@momentum-3.com. Opt-out requests must be renewed annually.
9. Intellectual Property
All content on this website and in our programs, including text, images, logos but not limited to text, graphics, logos, images, video, audio, and program materials, is the exclusive property of Momentum³ or its licensors unless otherwise stated and is protected by copyright, trademark, and other intellectual property laws.
Content may not be copied, reproduced, or modified, distributed, transmitted, displayed, published, or sold without expressed written consent from Momentum³. Unauthorized use may violate copyright, trademark, and other laws.
10. Third-Party Services and Links
Momentum³ may use third-party platforms for registration, communication, scheduling, payment processing or other services. Our website may contain links to third-party websites. Momentum³ is not responsible for the content or, privacy practices, or terms of these third-party websites or services. Your use of third-party services is at your own risk and subject to their terms and policies.
11. Limitation of Liability Indemnification
To the fullest extent permitted by law, Momentum³ shall not be liable for indirect, incidental, or consequential damages arising from participation in programs or use of this website.You agree to indemnify, defend, and hold harmless Momentum³, its owners, employees, coaches, volunteers, and affiliates against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your athlete’s participation in programs; (b) your violation of these Terms & Conditions; (c) your violation of any rights of another party; or (d) your use of our website or services.
12. Limitation of Liability
To the fullest extent permitted by law, Momentum³ and its owners, employees, coaches, volunteers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses arising from: (a) your access to or use of (or inability to access or use) our services; (b) any conduct or content of any third party; (c) unauthorized access, use, or alteration of your information; or (d) participation in programs or activities. In no event shall Momentum³’s total liability exceed the amount paid by you for the specific program or service giving rise to the claim.
13. Dispute Resolution
In the event of any dispute arising from these Terms & Conditions or your use of Momentum³ services, you agree to first attempt to resolve the dispute informally by contacting us. If the dispute cannot be resolved informally, you agree that any legal action must be brought in the state or federal courts located in Northern Virginia, and you consent to the exclusive jurisdiction of such courts.
For disputes involving claims under $10,000, you agree to resolve the dispute through binding arbitration in accordance with the rules of the American Arbitration Association, unless prohibited by law.
14. Governing Law
Momentum³ reserves the right to update modify or update these Terms & Conditions at any time in our sole discretion. Changes will be posted on this page with an updated effective date, effective immediately upon posting to this page with a revised effective date. Material changes will be communicated via email to registered users or through a notice on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. If you do not agree to the changes, you must discontinue use of our services.
These Terms & Conditions shall be governed by the laws of the Commonwealth of Virginia and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.

These Terms & Conditions, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Momentum³ regarding the use of our services and supersede all prior agreements and understandings.
